In contract law, a mistake is a incorrect belief, at the time of contracting, that certain facts are true. It can be argued as a defense and, if raised successfully, can lead to the agreement in question being found void abinitio or voidable. Alternatively, an equitable remedy may be provided by the courts.

Under Florida contract law, there are two different types of mistakes—unilateral=and mutual. When each of the parties to a contract is mistaken about the same material fact within their contract, that is referred to as a mutual mistake.  On the other hand, a unilateral mistake occurs when only one of the parties holds a mistaken belief relating to the contract and generally does not result in the contract being voided.
